"Off road abuse" is different than just plain off roading, but they have to prove you abused it, what led him to that conclusion? You can definately fight it, I had a transmission replacement at 95k and got it covered by warranty. They didn't want to at first, they took one look at my snorkel and jumped to the conclusion that I had water in it, I told him I barely have gotten the brake calipers wet let alone the transmission but they checked it all out and couldn't find any water so they honored the warranty, btw I have a 3" lift, 285's, aftermarket exhaust, so you can negate that from his excuses. If there is history of other vehicles of that production with that failure on forums print it out and show the service manager, hopefully he can be an advocate for you. Good luck

Not surprised in the least bit. I don't think you will win any appeals due to the increased tire size.
May I suggest in 4.56 or 4.88.
