Interesting read.....

People are getting pretty fired up. I understand having an opinion, it's just too bad there are some that choose to rip on others for their opinions. That's what I like about this forum, a lack of flaming others.

I don't agree with MT making so many public comments regarding the suit. IMO Domello is being smart about not commenting so publicly.

Well I think MT was trying to attempt to address the reasoning behind why the suit was filed in the first place. I'm no laywer, but my buess would be that he consulted one before he made the coments that he did. BUt your right, Do was smart by keeping quiet. Maybe that was requested my a lawyer, maybe that was his own doing. Either way all that were bashing MT and making claims of "DO's slider look better,.. MT sucks!..I'll never buy from MT!" .. have proabbaly hurt DO more than help.

 

 I was vocal myself in that thread. I hope it works out for both parties, but i do understand MT wanting to protect there trade mark.

If he was just rehashing what he listed as on the complaint he filed, he should have no problems.

 

Demello, on the other hand has no choice but to remain silent, as the defendant, anything he posts can be used against him. It would very difficult to have anything he posts as not be accepted as evidence.

I got too riled up last night.  I still believe that DO did nothing wrong though.  Oh well, that's what the legal system is for. 

I think the real question here is...where are my DO sliders???  Still haven't received them. 

It's really unfortunate to see this going on in our industry. All of these things cost a lot of money (trademarking concepts, lawsuits, defending lawsuits etc.) which we the consumer end up paying for through higher prices. There are a lot of good people getting hurt in this, and the only ones benifitting are the lawyers. You have to think hard about suporting these kinds of actions when you choose where to make your purchases.

Also people need to think twice about what they post up. Metal-Tech used a post from Ih8mud in their lawsuit filling against White Knuckle Offroad, along with a screen shot of posts on the Ih8mud forum page. Once the lawyers are involved nothing is off limits. Sad day. Unfortunatly, it's all about the money. 

 Lawsuits suck. wether your the one suing, or being sued, there one of the last things i'd ever want to be part. They draw out time, cost thousands, and even if you win, sometimes you could loose more than just money. That being said, most don't engage in lawsuits unless they absolutely have too. Mark is a smart guy. I'm sure he knew there was going to be some backlash on the forums concidering on how DO has such a strong following. however, when you file for a trade mark you have to protect it, other wise you risk loosing it. This much i understand.

 

 Whatever the outcome, i will still look to both compaines for products for my vehicle. I don't see any malicious intent from either company, nor do i feel MT is just out to put DO out of buisness. Is it all about the money? To some extent yes. Remeber, both are buisness, and as such need to make profit to survive. I do believe that both compaines have love for what they do and is why we have such great products from both sides. Hopefully it will all work itself out. And your right Overlander. Like i previously meantioned i can't help but wonder if those that were publicly bashing MT in the blue room have done more to hurt DO than help.
